DANIEL R. RUTHERFORD

Mr. Daniel R. Rutherford was born December 20, 1940 in Chicago, Illinois. Mr. Rutherford's father was employed by the United States Government and the family moved from Chicago to Baltimore, Maryland, and then to San Antonio. By the time Mr. Rutherford was three years old, he was living in San Antonio, Texas. Later, Mr. Rutherford's father was assigned to work in Seguin, Texas. Mr. Rutherford entered public school and graduated from Seguin High School in 1959.

Mr. Rutherford then attended San Antonio College and received an Associate of Arts Degree in 1962. From there Mr. Rutherford transferred to St. Mary's University and received his B.A. Degree in 1966, and his Law Degree from St. Mary's University School of Law in 1966. While in Law School Mr. Rutherford was extended an invitation to join the Tarlton Inn of Phi Delta Phi, a National Honorary Legal Fraternity. Membership in this Fraternity is limited to the top 10% of enrolled students. Mr. Rutherford finished law school fourth in his class graduating in 1966. Mr. Rutherford was licensed to practice law in the Texas Supreme Court and all of the Court's of Texas December 15, 1965, while still attending law school. During Mr. Rutherford's attendance at San Antonio College, he met the lovely Linda Diane Blasingame while engaged in summer employment in Houston, Texas, and they were married a year later. They have three children. A son, Stephen Tyler Rutherford, a partner in the firm, and two daughters, Cassandra Diane Rutherford (Scott) and Rebecca Jane Rutherford (Trapp).

After joining one of the older and more established law firms in San Antonio, Texas, Mr. Rutherford soon left to start his own practice and joined forces with County Judge Nelson Wolf in the practice of law. Later Mr. Rutherford and Mr. Wolf were joined in the practice of law by Mr. Rutherford's older brother Mr. Luther E. Rutherford. They continued to practice law together until the middle 70's when Mr. Dan Rutherford decided to launch his own, new law firm in the middle 70's. At this time Mr. Rutherford formed the partnership of Rutherford & Laye, P.C., which lasted for approximately 20 years until the early 1990's. During the period of this partnership the firm went from a general civil litigation to a criminal defense practice and ultimately to general civil litigation.

In the early 1990's the law firm of Rutherford & Laye, P.C. was terminated and Mr. Rutherford and his son S. Tyler Rutherford entered into a law firm with another fine young lawyer, Mr. James S. Bettersworth and the firm has continued to grow and prosper to it's present position in the San Antonio Metropolitan trade area.

Licenses

Besides being licensed in the Texas Supreme Court, Mr. Rutherford is licensed to practice before the United States Supreme Court and has been since 1975. Mr. Rutherford was licensed to practice in the Federal Courts of the Western District of Texas in 1970 and licensed to practice before the 5th Circuit Court of Appeals in New Orleans in 1975. Mr. Rutherford is also licensed to practice before the Federal Courts of the Eastern District of Texas. Further Mr. Rutherford is licensed to practice before the 6th Circuit Court of Appeals sitting in Cincinnati, Ohio and has been since 1983. Mr. Rutherford was licensed to practice before the United States Tax Court in 1983. Mr. Rutherford was licensed to practice before the 11th Circuit Court of Appeals sitting in Atlanta, Georgia in 1981.

For many years, Mr. Rutherford was a member of the Board of Directors of the San Antonio Trial Lawyer's Association, the Texas Trial Lawyers Association and the American Bar Association. Mr. Rutherford was board certified as a Civil Trial Law Specialist from 1978 until 2004. Mr. Rutherford was board certified as a Personal Injury Trial Law Specialist from 1989 to 2004. Mr. Rutherford was inducted into the College of the State Bar of Texas in 1991. Mr. Rutherford became a certified mediator and engages in a limited mediation practice.

SETTLEMENTS, JUDGEMENTS AND AWARDS

Mr. Rutherford has received numerous jury verdicts and settlements of $1,000,000.00 or more. In 1976, he received the second one million dollar verdict ever rendered in Bexar County. He has tried approximately 450 jury trials, appealed in excess of 125 cases to the Texas Courts of Appeals and has appeared before the Texas Supreme Court on at least 4 occasions. Mr. Rutherford has handled 75 appeals to the 5th Circuit Court of Appeals in New Orleans, Louisiana.
